Accelerated Rehabilitative Disposition (ARD)

Accelerated Rehabilitative Disposition (ARD) is offered to not only first-time DUI offenders, but most first-time offenders who are arrested for a misdemeanor. It is a great way to avoid not only jail and a license suspension, but upon completion, expungement of your record. If it is your first drug possession arrest, you may be eligible for what is known as "Section 17,” where upon successful completion of probation, your charges are dismissed and eligible for expungement.

Recently, the Philadelphia District Attorney’s Office started the Small Amount of Marijuana (SAM) program, where upon completion of community service and minimal fines, your charges are dismissed and entitled to automatic expungement.

All of these options make a bump in the road disappear! Having a lawyer who understands all of these options will ensure you that an arrest will not affect your current and future job prospects.

Alternative Treatment Courts

Due to prison overcrowding, courts around the country have begun to provide additional means of handling certain crimes.

Do you suffer from a serious mental illness?

Are you a Veteran who is suffering from PTSD?

Do you have a serious drug addiction?

Were any of the above a reason behind your arrest? If the answer is “yes” to any of these, you may be eligible for one of many programs that each county offers. It is important to have a lawyer who knows the ins and outs of each program. Each of these programs can save you jail time while putting your life back on track.

Driving Under the Influence

In Pennsylvania, driving under the influence is taken very seriously. Even on your first offense you can face a minimum of 3 days incarceration and a 12 month license suspension. The police MUST have probable cause before they can pull you over! Even if your rights have not been violated, there are alternative options that Philadelphia and the surrounding counties offer to first-time offenders that can save jail time and a license suspension.

Juvenile Crimes

Getting in trouble as a juvenile can have long-lasting effects on one’s life. We understand the many complexities involved in Delinquency matters. Having a lawyer that knows which crimes are eligible for expungement, and one who understands all of the services that each juvenile detention center offers throughout the state is critical in turning a juvenile delinquent into a prospering, contributing young adult.

Major Felonies

Pennsylvania, much like the federal system, imposes mandatory minimums for certain felonies.

WERE YOU arrested for drug delivery - and later found out it was in a school zone?

DO YOU have a prior violent felony conviction and were arrested for a robbery, burglary or aggravated assault?

WERE YOU arrested while in possession of a firearm?

IF THE ANSWER IS YES, you could be facing lengthy mandatory minimum sentences. Pursuant to the recent US Supreme Court case, Alleyne v. United States, prosecutors must now prove each and every fact that gives rise to a mandatory sentence beyond a reasonable doubt. This is a significant change in the law. The lawyers at Levy Law are prepared to negotiate and fight on your behalf to ensure that you aren’t subject to a mandatory minimum sentence.
